Terms of Use for Memory Game
Effective Date: September 6, 2026

1. Acceptance of Terms
By accessing or using Memory Game ("the Application"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Application.

2. User Accounts and Authentication
To use certain features of the Application, you must create an account using our Google Single Sign-On (SSO) integration. You are responsible for maintaining the security of your Google account credentials. We are not liable for any unauthorized access to your account resulting from a failure to secure your Google credentials.

3. Acceptable Use
You agree to use the Application only for lawful purposes. You agree not to:

Attempt to reverse-engineer, decompile, or hack the Application.

Use the Application in any way that could disable, overburden, damage, or impair our servers or network.

Attempt to gain unauthorized access to any parts of the Application or to other users' accounts.

4. Intellectual Property
All content, features, and functionality of the Application (including but not limited to text, graphics, logos, and game mechanics) are the exclusive property of Memory Game and are protected by applicable copyright and intellectual property laws.

5. User-Submitted Content
The Application allows you to upload photos, videos, and other media ("User Content") as part of creating personas, memorials, event boards, or shared memories.

By uploading User Content, you represent and warrant that:

You own the User Content, or you have obtained all necessary rights, licenses, and permissions to upload and share it;

If the User Content depicts another person, you have that person's permission to share their likeness through the Application; and

Your User Content does not infringe, violate, or misappropriate any third party's intellectual property, privacy, or other legal rights.

By uploading User Content, you grant Memory Game a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, distribute, and otherwise use that User Content in order to operate, provide, and promote the Application. You retain ownership of your User Content; this license does not transfer ownership to us.

You are solely responsible for the User Content you upload. We reserve the right, but have no obligation, to remove any User Content at our discretion, including in response to a claim that it infringes someone else's rights. If you believe User Content on the Application infringes your rights, please contact us at support@heaphomestead.com.

6. Termination
We reserve the right to terminate or suspend your access to the Application immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms of Use.

7. Limitation of Liability
In no event shall Memory Game, its developers, or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of data, use, or other intangible losses, resulting from your access to or use of or inability to access or use the Application.

8. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Application after those revisions become effective, you agree to be bound by the revised terms.
